Το νομικό πλαίσιο των κρατών μελών της Ευρωπαϊκής Ένωσης που δεν ανήκουν στην Ευρωζώνη.

Abstract

Η παρούσα πτυχιακή εργασία έχει ως βασικό αντικείμενο το νομικό πλαίσιο των κρατών μελών της Ευρωπαϊκής ΄Ενωσης που δεν ανήκουν στην ευρωζώνη. Αρχικά γίνεται μια ιστορική αναδρομή για το πως φτάσαμε στην δημιουργία της Οικονομικής και Νομισματικής Ένωσης(ΟΝΕ) και κατά συνέπεια αναλύονται τα τρία στάδια της. Πιο συγκεκριμένα γίνεται αναφορά στα κριτήρια σύγκλισης για την ολοκλήρωση του τρίτου σταδίου της ΟΝΕ και την εισαγωγή των κρατών μελών της Ευρωπαϊκής Ένωσης(ΕΕ) στο ευρώ. Στην κύρια ενότητα γίνεται εκτεταμένη αναφορά για τα κράτη μέλη με παρέκκλιση όσον αφορά το νομικό καθεστώς των κρατών μελών χωρίς ευρώ καθώς επίσης και αυτών που έχουν δυνατότητα μη συμμετοχής σε αυτό. Παρουσιάζεται ακόμη η διαδικασία υπαγωγής ενός κράτους μέλους με παρέκκλιση όπως και η διαδικασία κατάργησης του από το καθεστώς αυτό με σκοπό την ένταξη του στην Νομισματική ΄Ενωση. Έπειτα αναλύεται το Ευρωπαϊκό Σύστημα Κεντρικών Τραπεζών (Ε.Σ.Κ.Τ.) το οποίο αποτελείται από την Ευρωπαϊκή Κεντρική Τράπεζα (ΕΚΤ) και τις Εθνικές Κεντρικές Τράπεζες (ΕθνΚΤ) των κρατών μελών της ΕΕ, όπως και ο νέος Μηχανισμός Συναλλαγματικών Ισοτιμιών(ΜΣΙ) ο οποίος συνδέει τα νομίσματα των κρατών-μελών που βρίσκονται εκτός ζώνης ευρώ, με το ευρώ. Τέλος θεωρήσαμε σωστό να επεξεργαστούμε την περίοδο της οικονομικής κρίσης εντός και εκτός Ευρωζώνης καθώς και το πραγματικό αντίκτυπο αυτής στα κράτη μέλη της ΕΕ. Μετά από μια τέτοια κρίση είναι προφανές πως το μέλλον της Ευρωζώνης είναι αβέβαιο, οπότε κάνουμε μια μικρή αναφορά στα σενάρια που μπορεί να διαμορφώσουν το μέλλον της.

The present thesis has as main object the legal frame of member states of the European Union that do not belong in Eurozone. Initially, there is a historical retrospection on the three stages that the Economic and Monetary Union went through in order to be created. Specifically, we are looking into the criteria of convergence on the completion of the third stage of Economic and Monetary Union and also, in the insertion of member states of the European Union in the Euro area. In the main unit of our thesis, we analyze the legal regime of the member states which do not fulfill the convergence criteria (price stability, sound public finances, exchange rate stability and convergence in long-term interest rates), in order to join Eurozone, as well as the legal regime of the member states which, intentionally choose not to. Moreover, we introduce and discuss the process that a member state follows in order to enter regime derogation, along with the process of elimination of a member state from the regime derogation with main purpose the entry of that member state in Eurozone. Furthermore, we analyze the European System of Central Banks, which is consisted by the European Central Bank and the National Central Banks of the member states of the European Union. We also refer to the mechanism of exchange equivalences which connects the currencies of the member states that are not in Eurozone with the Euro area. To conclude, we analyze and compare the influence and the consequences of the crisis in relation to the member states that belong in Eurozone and the ones that do not. It is important to state the fact that after such crisis, obviously the future of Eurozone is uncertain, however, we refer to the scenarios that may form Eurozone in the future.
